The petitioner seeks regular bail in Bibhutipur P.S. Case No. 203 of 2013, registered for the offences punishable under Section 387 of the Indian Penal Code and other Sections of the Indian Penal Code.
The informant alleged that petitioner and Suraj Singh snatched key of motorcycle from the son of the informant and also demanded Rs.10,000/- as extortion. It is further alleged that in the morning, the petitioner came and damaged the motorcycle of the informant.
The learned counsel for the petitioner submits that the occurrence took place on 30.08.2013 but the First Information Report was lodged on 03.09.2013. Co-accused Suraj Singh has already been granted bail by a Bench of this Court vide order
Patna High Court Cr.Misc. No.37963 of 2014 (3) dt.19-01-2015 dated 09.05.2014 passed in Cr. Misc. No. 5484 of 2014. Learned counsel for the informant vehemently opposes the prayer for bail and submitted that the petitioner is a dreaded criminal of the locality as there are five cases pending against him.
Having considered the fact that there is no explanation for lodging the First Information Report after three days of the occurrence and on similar facts co-accused Suraj Singh has already been granted bail, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rosera at Samastipur in connection with Bibhutipur P.S. Case No. 203 of 2013.
