The petitioners seek bail in Special Case No. 3581/2019, arising out of Patrakarnagar P.S. Case No. 224/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that total 9 litres of foreign liquor has been recovered from the basement of hotel. It is further alleged that 11 empty bottles have been recovered from Room no. 205 of the hotel.
Learned counsel for the petitioners has submitted that petitioners are Waiter and Manager respectively of the hotel.
Patna High Court CR. MISC. No.29785 of 2019(2) dt.08-05-2019 2/2 They have been falsely implicated in this case merely on suspicion.
Petitioners are in custody since 04.04.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Special Case No. 3581/2019, arising out of Patrakarnagar P.S. Case No. 224/2019, subject to the conditions that both the bailors shall be the close relative of the petitioners.
