No doubt, the petitioner is named in the first information report and he carries criminal antecedent but according to first information report, it appears that the informant is not an eye witness of the alleged occurrence and in course of investigation though one witness claimed himself as an eye witness of the alleged occurrence, but he did not name the petitioner.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/-
