JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-01-2015 Since both the bail applications arise out of the Minapur P.S. Case No. 101 of 2013, therefore, they have been heard together and they are being disposed of by this common order.

Heard both sides.

The petitioners seek bail in Minapur P.S. Case No. 101 of 2013 registered under sections 328, 392, 412 and 120(B) of the Indian Penal Code. The petitioners were arrested

Patna High Court Cr.Misc. No.38089 of 2014 (3) dt.20-01-2015 2/2 in Ahiyapur P.S. Case No. 285 of 2013 and police obtained their confessional statement and thereafter remanded in this case.

It is submitted that on the basis of confessional statement the name of the petitioners figured in the case but no tangible evidence has been collected to show the involvement of the petitioners. Petitioners are in jail since 26.08.2013 but they have not been put on T.I.P. Having considered the fact that the petitioners were made accused on the basis of confessional statement and they are in jail since 26.08.2013, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Judicial Magistrate, Ist Class, Muzaffarpur in Minapur P.S. Case No. 101 of 2013.
