Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of NTPC P.S. Case No. 08 of 2021, disclosing offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The petitioner is in custody since 28.01.2021. It has been stated in paragraph-3 of the application that the petitioner has no criminal antecedent.

Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, has submitted that

Patna High Court CR. MISC. No.41813 of 2021(2) dt.06-01-2022 2/2 allegedly 10 litres of Desi Mahua wine was recovered from the motorcycle which the petitioner was riding with a pillion rider. Considering the quantity of illicit liquor, said to have been recovered from the petitioner's possession and his incarceration since 28.01.2021, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 2nd Additional Sessions Jude-cum-Special Judge, Bhagalpur in NTPC P.S. Case No. 08 of 2021.
