This application for anticipatory bail arises out of Mahila P.S. Case No. 72 of 2014 for the offence punishable under Sections 341, 342, 323, 498(A) and 504/34 of the Indian Penal Code.

The petitioner is brother of the husband of the informant. The husband of the informant is not an accused and there is allegation against two brothers of the husband of the informant of having assaulted her when her husband was away from her matrimonial home.

Learned senior counsel, appearing on behalf of the petitioner, has submitted that out of two brothers, named in the First Information Report, one has been allowed anticipatory bail by this Court by order dated 26.04.2019 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.30896 of 2019(2) dt.09-05-2019 2/2 27454 of 2019.

Considering the above submission, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bihar Sharif, Nalanda in Mahila P.S. Case No. 72 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
