====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State.

Petitioner is in custody since 28.06.2020 and seeks bail in connection with Bidupur P. S. Case No.130 of 2020 registered for the offences punishable under Sections 302, 201, 120(B)/ 34 of the I.P.C.

Petitioner happens to be Sardhu of the deceased and the stand of the petitioner is that at the time of alleged occurrence, he was at Rajasthan. The mobile location of petitioner was verified by the Investigating Officer and at Para70 of the case diary, it has specifically been mentioned that the tower location of mobile phone of petitioner was found at

Patna High Court CR. MISC. No.32019 of 2020(3) dt.25-01-2021 2/2 Rajasthan at the relevant time. However, in spite of that the Investigating Officer has submitted charge-sheet against the petitioner.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P. S. Case No.130 of 2020.
