2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 379 of the Indian Penal Code.

3. The case of the prosecution is that the informant has parked his bike while he was shopping in Vishal Mega Mart when he came out of the Vishal Mega Mart, he found that his bike was not there. In CCTV, it was found that a boy who was wearing white shirt and black jeans who has masked his face has stolen the bike.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the

Patna High Court CR. MISC. No.31507 of 2025(2) dt.15-05-2025 2/2 petitioner has submitted that his name has surfaced in this case as he is having similar nature of antecedent of three cases. It has also been submitted that nothing has been recovered from the possession of this petitioner. He has further submitted that the case is triable by Magistrate and it carries punishment of only three years. Moreover, the petitioner is languishing in judicial custody since 24.05.2024.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rampur P.S. Case No. 151 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
