JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2022 The short prayer of the petitioner in the present writ petition is to direct the Circle Officer, Itarhi, District Buxar i.e. the Respondent No. 3 to remove the encroachment made by the encroachers over plot no. 1011, situated in front of Khata No. 278, plot no. 997, Thana no. 458 in village Barka Gaon, Police Station Itarhi, District Buxar.

It is apparent from the writ petition that one Encroachment Case No. 2 of 2019-20 is pending before the Respondent no.3.

Patna High Court CWJC No.2970 of 2021(2) dt.18-08-2022 2/2 In such view of the matter, the present writ petition stands disposed of with a direction to the Respondent No. 3 to conclude the proceeding of the aforesaid Encroachment Case No. 2 of 2019-20, if not already concluded, by passing final order under section 6(1) of the Bihar Public Land Encroachment Act, 1956 and thereafter take appropriate steps in accordance with law.

The writ petition stands disposed of on the aforesaid term.
