The petitioner seeks bail in Parasi P.S. Case No. 46 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, on 08.08.2020 at about 11.30 am while the informant's son was cleaning drain, in the meantime, all the accused persons including petitioner having armed with Khanti, Danda came there and started filling earth in the said drain and on protest, petitioner assaulted the son of informant and when the informant's Bhabhu came to save she was also assaulted by co-accused.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to village politics and previous enmity. Admittedly, there is land dispute
Patna High Court CR. MISC. No.41982 of 2021(2) dt.26-10-2021 2/2 between the parties from before. There is general and omnibus allegation. The Doctor has found injury to be simple in nature. Petitioner is in custody since 05.02.2021 having clean antecedent.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Arwal in connection with Parasi P.S. Case No. 46 of 2020.
