2. The petitioner seeks bail in connection with Shambo (Samho) P.S. Case No. 54 of 2024 instituted for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 118(1) of the BNS.
3. Prosecution case in short is that on 11-11-2024 at about 2:30 PM, when informant was going to his field for ploughing, on tractor loaded with fertilizer and seeds, on the way, 100 persons including the petitioner surrounded him and looted the seeds and fertilizers and assaulted him. In the
Patna High Court CR. MISC. No.33977 of 2025(2) dt.17-06-2025 2/3 meantime, when Gauri Shankar Singh and Rohit Kumar came to save informant, all the accused persons, who were 36 in number assaulted them as a result of which three persons sustained injuries.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. The specific allegation of assault is levelled against one Bilat Bind. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.01.2025 and has no criminal antecedent. The co-accused person has already been granted bail by this Court vide order dated 08.05.2025 passed in Cr. Misc. No. 27465 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of
Patna High Court CR. MISC. No.33977 of 2025(2) dt.17-06-2025 3/3 the like amount each to the satisfaction of Court below/concerned Court in connection with Shambo (Samho) P.S. Case No. 54 of 2024.
