2. The petitioner is apprehending arrest in connection with Sessions Trial No. 130/2023, arising out of Bagen Gola P.S. Case No. 82/2022 registered on 20.08.2022 for the offences punishable under Sections 364, 120B/34, 302/201 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against three named accused persons including the present petitioner alleging therein that they have made the son of the informant traceless under a conspiracy and the son of the informant has not returned till date.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The name of the petitioner has figured in this case on the confessional

No.35003 of 2024(5) dt.04-10-2024 2/2 statement of the co-accused, namely, Ravindra Yadav @ Ravindra Kumar, who has been granted bail by a co-ordinate Bench of this Court vide order dated 19.06.2023 passed in Criminal Miscellaneous No. 71668 of 2022. The antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the petitioner is the nephew of co-accused, Ravindra Kumar who has confessed the name of the petitioner in this case and except confession, there is nothing against him.

6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Buxar, in connection with Sessions Trial No. 130/2023, arising out of Bagen Gola P.S. Case No. 82/2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J) Ashwini/- U T
