Petitioner apprehends his arrest in Vishnupad P.S. Case No.80 of 2018, registered under Section 30(a) of the Bihar Excise Act.

The informant got information that Sunny Yadav and Butta Yadav @ Kachhua had kept liquor by the side of boundary of Rajnandan Yadav but when the police went there both the persons managed to flee away taking advantage of darkness. Learned counsel for the petitioner submits that 6.5 liters liquor was recovered by the side of boundary of Rajnandan Yadav but petitioner has falsely been implicated in the case. Nothing has been recovered from conscious possession of the petitioner.

No.30632 of 2019(2) dt.09-05-2019 2/2 Taking into consideration the fact that the recovery is made by the side of boundary of Rajnandan Yadav, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Vishnupad P.S. Case No.80 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
