The petitioner apprehends his arrest in a case registered for the offence under Section 307,379 and other allied Sections of the Indian Penal Code.

As per the prosecution case, the FIR named accused persons including this petitioner entered into the house of informant, armed with Dabiya in drunken state, and gave Dabiya blow to the informant due to which he sustained head injury. It is further alleged that this petitioner also took out Rs. 5000/- from the informant.

It is submitted on behalf of petitioner that there is delay of three days in lodging the FIR and there is no plausible explanation of delay. The injury is simple in nature. There is land dispute between the parties. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.33081 of 2022(2) dt.18-10-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Khagaria in connection with Gogri P.S. Case No. 246/2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
