The petitioner seeks bail in Kishanpur P.S. Case No.130 of 2020, registered under Sections 147, 149, 341, 342, 323, 307, 324, 325, 319, 504 and 506 of the Indian Penal Code and 27 of the Arm Act.

The informant Md. Sagir Alam named the petitioner and 13 others and alleged that the accused persons along with five unknown persons came having iron rod and pistol in their hands, they pushed the motorcycle of the informant and informant fell down on the ground. On the order of Md. Mushtaq, all the accused persons assaulted him with iron rod. It is further alleged that the petitioner was fleeing away firing in the air but the villagers caught him and handed him over to the

Learned counsel for the petitioner submits that earlier also the informant lodged the case against the petitioner. There is omnibus and general allegation against the petitioner. The petitioner is in jail since 31.05.2020. The petitioner has already remained in jail for six months. No firearm was recovered from possession of the petitioner. The informant got as many as three injuries out of which one injury found on the left Alna was found fractured and opined to be grievous in nature. Taking into consideration the facts and nature of allegation made against the petitioner and the fact that the petitioner has already remained in jail for six months, petitioner, namely, Md. Intekhab Alam @ Md. Intekhar Aalam @ Bittu is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Kishanpur P.S.
