JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 26-09-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Learned counsel for the petitioner is directed to remove the defects within four weeks.

Petitioner apprehends his arrest in a case registered for the offence punishable u/s 341, 323, 325, 354, 379, 504 & 506/34 of the IPC.

Allegedly, the petitioner took one box in which gold and cash was kept, from the house of informant and was keeping it in his house and on objection, other FIR named accused entered into his house with deadly weapons. On the order of petitioner, the accused persons assaulted informant and his wife. It is alleged that petitioner tried to press the neck of informant with an intention to kill him.

He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioner as no criminal antecedent, as mentioned in para-3 of this application. It is submitted that after investigation, police has filed the final form but the court below differing with the final form, took cognizance against the petitioner. Petitioner is working in Army. Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sikandara P.S. Case No.69 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
