2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302 and 201 of the Indian Penal Code, registered in connection with Simri P.S. Case No. 259 of 2023.

3. The allegation against the petitioner along with others is of killing the daughter of the informant by hanging.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has

He submitted that the F.I.R. itself shows that no motive has been assigned for murder of the deceased. The deceased and the petitioner solemnized marriage 15 years prior to the occurrence. He further submitted that the confessional statement of the petitioner has no evidentiary value in the eyes of law and it is not leading to recovery. Moreover, petitioner is a person of clean antecedent and he is in custody since 07.12.2023.

5. Learned APP for the State has opposed the prayer of bail by submitting that the petitioner has confessed his guilt and given vivid description about the murder of the deceased in his confessional statement.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Darbhanga in connection with Simri P.S. Case No. 259 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
