2. The petitioner is apprehending arrest in connection with Hussainganj P.S. Case No. 440/2024 registered on 12.12.2024 for the offences punishable under Sections 191(2), 190, 126(2), 127(2), 115(2), 118(1), 109, 303(2), 351(2), 352 of the BNS, 2023.
3. As per the prosecution, the F.I.R. has been lodged against fifteen named accused persons along with 15-20 unknown individuals, including the petitioner. It is alleged that on 11.12.2024, all the accused persons assaulted the informant and his son with swords and farsa, causing injuries to both. It is further alleged that the accused persons snatched a sum of 5,00,000 from the pocket of the informant. Additionally, on ₹
Patna High Court CR. MISC. No.31688 of 2025(3) dt.23-07-2025 2/3 12.12.2024, all the accused persons allegedly assaulted the informant's nephew with farsa, sword, spear, lathi, and knife, as a result of which he sustained severe injuries.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to village-level political rivalry and personal enmity. It is contended that the petitioner has no connection with the informant and was not present at the place of occurrence at the relevant time. However, due to his previous antecedents, his name has been maliciously inserted in the F.I.R. despite having no role in the incident.
5. Learned APP for the State opposes the prayer for bail and submits that there are specific allegations against the petitioner, and his criminal antecedents are also not clean, which disentitles him from the benefit of bail.
6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Hussainganj P.S. Case No of 440/2024, pending before the learned CJM, Siwan is hereby rejected.
7. However, if the petitioner surrenders before the Trial Court within six weeks from today, the Trial Court is
