Mr.Ajay Behari Sinha (GA8) CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-02-2023 Heard learned counsel for the petitioners and the State in all these writ applications which have been taken up together with the consent of the parties.
The petitioners, in these writ applications, have a common prayer to direct the respondent authorities to consider their cases for payment of equal salary as is being paid to the other government employees on the same post on the principle of equal pay for equal work. They have also prayed for payment of arrears of salary arising out of the difference between the pay scale presently allowed to the petitioners and the pay scale to which they are entitled to.
The petitioners have been appointed on compassionate basis in the various offices and the departments of the
16/17 government of Bihar. They have been appointed on the pay scale of Rs. 3500-4590/- whereas the other employees holding same post are being paid salary on the pay scale of Rs. 40006000/-. The only reason for not allowing the petitioners the pay scale of Rs. 4000-6000/- is that they were appointed on compassionate ground.
It appears that the identical issue came for consideration earlier before the Hon'ble Division Bench of this Court in LPA No. 167/2016. By order dated 23.06.2017 passed by Hon'ble Division Bench it was held that the appointees on the compassionate ground would also be entitled for the scale of Rs. 4000-6000/-. Accordingly, directions were issued to the competent authorities who have acted and issued consequential orders giving effect to the order of this Court. Recently, in CWJC No. 17/2023 disposed of on 15.02.2023 this Court had occasion to examine this aspect of the matter and similar reliefs have been granted to the petitioners in the said writ application.
Learned counsel for the State in all these writ applications are present, they agree that so far as the issue involved in the present writ applications are concerned, those are covered by the judgment of this Court in LPA No. 167/2016.
17/17 In the aforesaid view of the matter, this Court is disposing of all these writ applications with a direction to the concerned appointing authorities of the respective petitioners to consider the claims of the petitioners in the light of the decision of the Hon'ble Division Bench in LPA No. 167/2016 and several orders passed by this Court from time to time as also the consequential orders passed by the authorities to give effect to those orders. Let such consideration be given within a period of three months from the date of receipt/production of a copy of this order.
It goes without saying that upon examination of their claims, if the petitioners are found entitled for the identical reliefs who have been granted to others, consequential benefits shall follow.
