JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Harsidhi P.S. Case No.76 of 2019 registered under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that regarding the theft of motorcycle of the informant, Mohan Lal

Patna High Court CR. MISC. No.31776 of 2020(2) dt.10-12-2020 2/2 Sahni, Harsidhi P.S. Case No.76 of 2019 was instituted on 05.03.2019 against unknown but in course of investigation, petitioner was apprehended in Harsidhi P.S. Case No.97 of 2019 and thereafter, police recorded his confessional statement showing involvement in the present case and remanded in the present case on 13.08.2019. Further submission is that petitioner was arrested in Harsidhi P.S. Case No. 97 of 2019 and thereafter, he was remanded in four other cases but he is on bail in all other cases, except Harsidhi P.S. Case No.70 of 2019, as detailed in paragraph 3 of the petition.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Harsidhi P.S. Case No.76 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
