JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-05-2019 The present writ petition has been filed challenging the action of the respondents whereby and whereunder private respondent No. 11 has wrongly been appointed in the Sakshar Bharat Mission scheme and the petitioner has been wrongly removed from the services.
Patna High Court CWJC No.14917 of 2016(5) dt.20-05-2019 2/3 The learned counsel for the respondents, referring to the counter affidavit filed by them, has submitted that as per letter dated 9.10.2018 issued by the Director, Mass Education, Education Department, Government of Bihar, the Sakshar Bharat Mission Scheme has come to an end w.e.f. 1.4.2018 and the appointment letters of the Prerak and other employees working in the said project specifically states that once the said project/ scheme comes to an end, the services of the employees would also stand terminated automatically. It is further submitted that the said letter dated 9.10.2018 further mentions that the services of the employees of the said scheme has already stood terminated w.e.f. 1.4.2018.
Having regard to the submissions made by the learned counsel for the respondents, this Court is of the view that since the scheme itself has been wound up and the employees of the said scheme are also not in service, as is apparent from the letter dated 9.10.2018, no lis survives for adjudication in the present writ petition.
At this juncture, the learned counsel for the petitioner submits that he be permitted to withdraw the present writ petition with liberty to approach this Court in case the said scheme subsists or is survived.
