JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-07-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For quashing parwana as contained in Annexure-6 of writ application whereby and whereunder Land Settlement Parwana has been issued to Respondents no. 9 and 10.
(ii). For restraining respondents from taking possession and demolishing the house and land of the petitioner."

At the outset, the learned counsel for the RespondentState submits, by referring to paragraph no. 12 of the counter affidavit, filed on behalf of the Respondents No. 1 to 8 that the Respondents have got nothing to do with plot, appertaining to Chak Khesra no. 178, upon which the houses of the petitioner has been constructed, however, they are only removing the encroachment made over Plot No. 177, which is reserved for Scheduled Caste and landless labourers and settled with the private Respondents No. 9 and 10 under the Dakhal Dehani Scheme.

In view of the aforesaid, the learned counsel for the petitioner submits that the Respondents be directed to conduct measurement of the aforesaid plot in question i.e. the one appertaining to Chak Khesra No. 178, situated at Mauza- Eraji Gangeli, District-Purnea and demarcate the same so that he is not harassed from time to time. It is directed accordingly. 4.
