JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.4.2014 in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim has alleged that this petitioner was instrumental in kidnapping her who is the father of alleged boy Pawan Kumar Mehta.

It is submitted by the learned counsel for the petitioner that though in 164 Cr.P.C. statement the victim has alleged accusation against this petitioner also but in 161 Cr.P.C. statement which is recorded in paragraph 16 of the case diary she has stated

Patna High Court Cr.Misc. No.36922 of 2014 (3) dt.16-01-2015 that she was in love with Pawan since last five years and she was never kidnapped. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Balua Bazar P.S. Case No. 5 of 2014.
