The petitioner is in custody in connection with Jhanjharpur P.S. Case No. 119 of 2018, G.R. No.1238 of 2018 for the offence under Section 380 of the Indian Penal Code. Allegation against the petitioner is that he has committed the theft in the house of informant. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and petitioner was not named in the F.I.R and nothing was recovered from the conscious possession of the petitioner. He further submits that petitioner is in custody since 12.10.2018.
Learned counsel further submits that co-accused Sujeet Kumar Singh from whose possession recovery was made
Patna High Court CR. MISC. No.29940 of 2019(2) dt.06-05-2019 2/2 and he has been granted bail by the learned court below in B.P.No.116 of 2018 (C.C.) vide order dated 03.11.2018 Considering the fact that petitioner was not named in the F.I.R. and he is in custody since 12.10.2018 and the fact that in similar circumstance other co-accused Sujeet Kumar Singh has been granted bail by the learned court below, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Jhanjharpur, in connection with Jhanjharpur P.S. Case No. 119 of 2018.
