The petitioner seeks regular bail in connection with Punaura P.S. Case No. 52 of 2019 for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 37(b) (c) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 74.700 liters of foreign illicit liquor from a hut and the petitioner is said to be apprehended while fleeing away from the said hut. The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and is languishing in custody since 21.03.2019. It is further submitted that neither the petitioner is owner of the hut nor any foreign illicit liquor has been recovered from possession of the petitioner herein.
