JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Bisfi (Patauna) P.S. Case No. 171 of 2017, disclosing offences under Sections 341, 323, 308, 354, 506 of the Indian Penal Code.
Allegation as per F.I.R. is that while son of the informant was coming with cycle, the petitioner dashed by that cycle, due to which, petitioner caught hold of his son and assaulted on his neck, due to which, he became unconscious. Submission of the learned counsel for the petitioner is that as a matter of fact due to accident there is an altercation between the parties, due to the same, he has falsely been made accused in this case and injury report also does not disclose the injuries dangerous to life.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Benipatti, Madhubani, in connection with Bisfi (Patauna) P.S. Case No. 171 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
