2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 363 , 365 , 366(A) , 323 , 504, 506 and 34 of the Indian Penal Code.

3. Allegation against these petitioners is that they

Patna High Court CR. MISC. No.33323 of 2023(4) dt.21-09-2023 2/2 kidnapped the minor daughter of the informant with the intention to solemnize marriage .

4. It is submitted on behalf of the petitioners that victim in her statement under section 164 Cr. P . C . has denied prosecution case and stated that after being reprimanded by her mother, she left her house and went to the house of Mausi. No one has kidnapped her.

5. Learned counsel for the State opposed the bail petition.

6 Considering the statement of the victim under section 164 Cr. P . C . and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A . C . J . M. 1st, Araria in connection with Kursakanta P.S. Case No. 57 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
