JUSTICE PARTHA SARTHY ORAL ORDER 09-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sarai P.S. Case no. 342 of 2019 registered under sections 307, 341, 342, 323, 324, 379, 504 and 34 of the Indian Penal Code.

The allegation against the petitioner is of having assaulted the informant along with other persons. In course of investigation the informant took the name of the petitioner as one of the persons who had assaulted him.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 16.3.2020 passed in Cr. Misc. no. 84604 of 2019 giving liberty to the petitioner to renew his prayer for bail after six months. It is submitted that it has been more than eight months since passing of the said order dated 16.3.2020. Petitioner has no criminal antecedent and is in custody since 25.9.2019.

The application for bail is opposed by learned APP for the State.

No.32280 of 2020(2) dt.09-12-2020 2/2 Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the liberty granted by the aforesaid order dated 16.3.2020 and the petitioner being in custody since 25.9.2019, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sarai P.S. Case no.342 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Hajipur, Vaishali.
