The petitioner seeks bail in anticipation of his arrest in connection with Barahiya P. S. Case No. 89 of 2017 dated 08.05.2017 instituted for the offences under Sections 461, 379 and 411 of the Indian Penal Code. The name of the petitioner has transpired in the confession of a co-accused namely Abhishek Kumar. Learned counsel for the petitioner has submitted that even in that confession, the name of the petitioner was taken as Sanjay Kumar Singh but with the correct parentage. However later, finding that no Sanjay Kumar

Patna High Court Cr.Misc. No.72489 of 2018(2) dt.20-12-2018 2/2 Singh existed, an alias name was added and thereby the petitioner is sought to be prosecuted in the present case. The petitioner does not have any criminal antecedents and nothing has been recovered from his possession.

Considering the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P. S. Case No. 89 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
