The petitioner seeks bail in connection with Magadh Medical P.S. Case No. 262 of 2019 for the offence under Sections 279, 337, 338 and 304 of the Indian Penal Code and Section 37(1) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 02.03.2019 passed in Cr. Misc. No. 13561 of 2020. Now the prayer for bail of this petitioner has been renewed on the ground of custody as the petitioner is languishing in judicial custody

Patna High Court CR. MISC. No.32585 of 2020(2) dt.09-12-2020 2/2 since 13.11.2019 i.e. more than one year and the likelihood of conclusion of trial is not expected in near future. Therefore, petitioner may be enlarged on bail. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Special Judge, Excise, Gaya in connection with Magadh Medical P.S. Case No. 262 of 2019.
