2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 341 ,
Patna High Court CR. MISC. No.37581 of 2024(3) dt.12-08-2024 2/3 323 , 379, 308 , 353 and 504 of the Indian Penal Code . 3 . As per the prosecution case , on the alleged date and time of occurrence , when the informant had gone to inspect industrial area premises of Ravindra Yadav , these petitioners along with other co-accused persons and fifty unknown persons assaulted the informant and others by means of iron rod and bamboo stick due to which they sustained multiple injuries.
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this case due to ulterior motive . Allegation of assault is general and omnibus against these petitioners and no specific allegation of assault is against them.
5. Learned counsel for the State opposed the bail petition and submitted that these petitioners along with other co-accused persons assaulted the informant by means of iron rod and bamboo stick due to which informant and others sustained multiple injuries.
6 Considering the fact that informant, who is government official in Electricity Department and others were simply discharging their duty they were assaulted by these petitioners and others due to which informant and others sustained multiple injuries, the prayer for pre-arrest bail of the
Patna High Court CR. MISC. No.37581 of 2024(3) dt.12-08-2024 3/3 petitioners is rejected.
