2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Chakia P.S. Case No. 85 of 2021, lodged on 02.04.2021, under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioners. Allegation against petitioner No. 1 is that he caught the

Allegation against petitioner No. 2 is that he had assaulted by sharp cutting weapon on he neck of the informant due to which he sustained injury and admitted to hospital. Further allegation of snatching gold chain and Mangalsutra are there.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that for the same date and place of occurrence there is case and counter-case. He submits that both informant and petitioners are gotiya and due to family dispute the scuffling took place in result the informant side has brutally assaulted petitioner No. 1 and it is due to this reason a criminal case has also been lodged by petitioner No. 1 against the informant and others, which is annexed as Annexure P/2. Counsel further submits that antecedent of the petitioners are clean and the injury alleged to have been caused are simple in nature. Counsel further submits that petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them.
5. Learned APP for the State opposes the prayer for bail of the petitioners but submits that there is case and countercase between the parties and both are resident of the same

Considering the fact that for the same date and place of occurrence scuffling took place from both sides, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chakia P.S. Case No. 85 of 2021 subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
7. And further condition that the Trial Court shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the Trial Court shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above mentioned order shall not be delayed for purpose of or in the name of verification.
