The petitioner apprehends his arrest in Pandaul P.S. Case No.24 of 2019 registered under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The informant got information that the petitioner had kept country made liquor in a hut situated near brick kiln of village Bhagwatipur.

The learned counsel for the petitioner submits that hut is not owned by the petitioner. The petitioner has falsely been implicated in the case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

No.30653 of 2019(2) dt.09-05-2019 2/2 Taking into consideration the facts aforesaid and the fact that petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise Act, Madhubani in connection with Pandaul P.S. Case No.24 of 2019 bearing G.R. No.291/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
