The writ petitioner has sought a direction for his appointment on Group D post in the District Hospital Jamui from the panel prepared for the said purpose. The respondents have filed a counter affidavit. It is their specific case that panel has been prepared on the basis of date of birth. None who is younger than the petitioner/junior to the petitioner in the panel, has been appointed. In view of the averments made in the counter

Patna High Court CWJC No.480 of 2015(6) dt.26-02-2019 2/2 affidavit, petitioner's Counsel submits that he would be entitled to consideration of his claim as per seniority. In the circumstances no order need be passed in the writ petition since none below the petitioner in the panel has been appointed in the process.

The writ petition is, therefore, devoid of merit and the same is dismissed.
