The petitioner seeks bail in Baruraj P.S. Case No. 269/2018, instituted for offences under Section(s) 307, 120(B)/34 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that F.I.R. is against unknown. Petitioner has been arrested in this case merely on suspicion.

It is mentioned in para 9 of bail petition that nothing has been recovered from possession of this petitioner. Petitioner was put on T.I.P. but he was not identified.

It is alleged in the written report that on the date of occurrence while elder brother of informant was returning home

Patna High Court CR. MISC. No.32421 of 2019(2) dt.16-07-2019 2/2 after withdrawing money from Bank, two miscreants were following him on motorcycle. They opened firing on the brother of informant causing injury in his back and bullet passed through his stomach. Thereafter brother of informant was brought to hospital.

Petitioner is in custody since 24.12.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Prity Kumari, J.M. 1st Class, Muzaffarpur, in connection with Baruraj P.S. Case No. 269/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
