The petitioner is accused in connection with S. Tr. No. 27 of 2019 arising out of Asthawan P.S. Case No. 85 of 2018 registered under section 302/34 of the I.P.C. and section 3/4 of the Dian Prohibition Act pending in the Court of 2nd Additional District and Sessions Judge, Nalanda at Biharsharif. Submission is that petitioner is innocent and has falsely been implicated in the present case only on the basis of suspicion. Further submission is that petitioner is cousin nephew of the informant. He has been dragged in this case due to land dispute. Petitioner is in custody since 14.05.2018. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending

Patna High Court CR. MISC. No.31271 of 2019(3) dt.09-07-2019 2/2 that on perusal of first information report itself, it appears that there is direct allegation of assault to the mother of the informant against the petitioner by means of Katta on her vital part, as a result of which, she died.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
