Rahui P.S. Case No.29 of 2014 was registered and the petitioner was arrested. He filed B.P. No.667 of 2014 before the learned Sessions Judge, Nalanda at Biharsharif. The application was rejected on 11.08.2014. Hence, this application under Section 439 of the Code of Criminal Procedure.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
It is, no doubt, true that the complainant made an
Patna High Court Cr.Misc. No.38002 of 2014 (2) dt.14-01-2015 2/2 allegation to the effect that the petitioner had sprinkled kerosene oil with a view to set her afire and that she escaped. The necessity to detain the petitioner was only to ensure that he does not meddle with the investigation. It is brought to the notice of the Court that chargesheet has since been filed. Therefore, the application is allowed. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjan Kumar Mishra, J.M. 1st Class, at Biharsharif, Nalanda in connection with Rahui P.S.Case No.29 of 2014.
