Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Banshi P.S. Case No. 01 of 2021, registered for the offence punishable under Sections 420 and 414 of the Indian Penal Code.

The petitioner is in custody since 12.01.2021. It is alleged that when the police had gone to apprehend the petitioner in connection with some other case, from his possession a stolen motorcycle was recovered. Learned counsel appearing on behalf of the petitioner has submitted that since charge-sheet has been submitted and the petitioner has remained in custody since 12.01.2021, his

Patna High Court CR. MISC. No.42314 of 2021(2) dt.06-01-2022 2/2 prayer for bail may be sympathetically considered. Considering the aforesaid submission and the fact that the trial is not likely to conclude in near future, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Arwal, in Banshi P.S. Case No. 01 of 2021.

The Court notices that the petitioner has criminal antecedent. It is, therefore, observed that if the petitioner is found indulging in similar offence in future, the prosecution shall be at liberty to approach this Court for cancellation of bail granted by virtue of the present order.
