JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 304(B), 120(B) and 201 of Indian Penal Code.

As per prosecution case, this petitioner along with other FIR named accused persons tortured and caused death to daughter of the informant due to non-fullfilment of demand of dowry.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that specific accusation is against husband of the deceased who is already in custody. Petitioner is uncle of husband of the deceased and he is separate in mess and property. Police after investigation submitted final form. Petitioner has got clean antecedent.

No.33124 of 2022(2) dt.15-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in Tariyani P. S. Case No. 51 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
