JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Main (Paibigha O.P.) P.S. Case No. 10 of 2014, corresponding to NDPS Case No. 22 of 2014/174 of 2017, registered for the offences punishable under Sections 20 and 25 of N.D.P.S. Act.

It appears from the FIR that there was some altercation going on between the villagers on which informant caught hold the two accused persons and on search one bag containing ganja was recovered, who disclosed that they have brought the same from the house of petitioner and house of petitioner was raided and 2 Kg. of ganja was recovered. It further appears that petitioner is accused in three other cases. Submission of learned counsel for the petitioner is that his house is joint house and in all the previous cases he has

Patna High Court CR. MISC. No.32681 of 2019(2) dt.29-07-2019 2/2 already been acquitted. Further submission is that petitioner is suffering from cancer disease and in support thereof he has filed Annexure-2 series.

Heard learned APP also.

Considering the allegation and criminal antecedent, I am not inclined to grant the privilege of anticipatory bail to the petitioner. If petitioner surrenders and prays for regular bail, the same shall be considered on the basis of above submission and the documents that he is suffering from cancer disease and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
