The petitioner is apprehending his arrest in connection with Khodawanpur P.S.Case no.174 of 2017 corresponding to G.R.No.319 of 2017 , registered for offences punishable under Sections 147, 148, 323, 307, 333,353, 379,325, 427 and 335 of the Indian Penal Code.
Allegation of blocking the road is against the petitioner and other accused persons and raising slogans as well as damaging the public property.
Submission of the learned counsel for the petitioner is that though he is named in the FIR, nothing specific has been attributed against him and he has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.557 of 2019(3) dt.22-01-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Begusarai in connection with Khodawanpur P.S.Case No.174 of 2017 arising out of G.R.No.319 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case. .
With the aforesaid observation, this application is allowed.
