Petitioner has preferred the present modification application for modification of the order, dated 15.04.2019, passed in Cr. Misc. No. 22974 of 2019.
It has been submitted that while granting bail to the petitioner condition no. 1 was that one of the bailors would be a close relative of the petitioner having sufficient immovable property who would file an affidavit stating his relationship with the petitioner, the petitioner submits that he is a labourer and none of his relatives have immovable property although his father has a motorcycle registered in his name, which he is ready to give as surety.
Considering the same, the order, dated 15.04.2019,
Patna High Court CR. MISC. No.30755 of 2019(2) dt.08-05-2019 2/2 passed in Cr. Misc. No. 22974 of 2019, is modified to the extent that condition no. 1 is deleted, but, another condition in place of condition no. 1 is inserted, which reads as follows : "That the petitioner will appear before the learned Court below as and when required and failure to appear on the said date will entail cancellation of his bail bonds."
The order, dated 15.04.2019, passed in Cr. Misc. No. 22974 of 2019, is modified to the extent indicated above. (Nilu Agrawal, J) Shamshad/- U T
