26-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Town P.S. Case No. 313 of 2020, corresponding to G.R. No. 2532 of 2020, registered for the offence under Sections 401, 379, 413, 414 of the Indian Penal Code.

On 21.12.2020 at about 9:00 AM, on a secret information that in the town, a gang of motorcycle thieves is active, the informant formed a team and started checking vehicles. At about 10:30 AM, during course of checking of vehicles, two persons riding on a motorcycle, on seeing the police party, started fleeing away, but on chase, they were apprehended with the stolen motorcycle and on being asked, they disclosed the name of petitioner and other, as their associates, who are indulged in stealing and selling the stolen motorcycles.

No.42209 of 2021(2) dt.26-10-2021 2/2 It is submitted on behalf of petitioner that the stolen motorcycle has not been recovered from the possession of the petitioner and petitioner has been made accused in this case only on the basis of confessional statement of co-accused persons, who were apprehended on spot with stolen motorcycle. Petitioner has got clean antecedent and he is in custody since 22.12.2020. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Town P.S. Case No. 313 of 2020, corresponding to G.R. No. 2532 of 2020.
