The petitioner seeks bail in connection with Bodhgaya P.S. Case No. 891 of 2023 instituted for the offences punishable under Sections 406, 419, 420, 120B, 467, 468/34 of the Indian Penal Code.

The allegation against the petitiones along with others are said to have indulged in cheating of innocent common people in the name of giving job by using social media and technology.

Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. He submitted that one mobile phone has been recovered from the
Patna High Court CR. MISC. No.36894 of 2024(2) dt.15-05-2024 2/2 possession of this petitioner and the said mobiles belong to him. The petitioner has not cheated anyone as well as no any complaint was registered against him. Except mobile phones, no any incriminating article has been recovered from the conscious possession of the petitioner. Charge-sheet has been submitted in this case. The petitioner is in custody since 02.12.2023 and has no criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 18-04-2024, passed in Cr. Misc. No. 27693 of 2024.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.
Considering the aforesaid facts and circumstances of the case as well as the period of custody undergone by the petitioner and clean antecedent of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bodhgaya P.S. Case No. 891 of 2023.
