1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 376, 323 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent, petitioner no.1 is a lady and the informant alleges that Rakesh, on pretext of marriage, committed wrong act with her and asked not to disclose to anyone and thereafter continued with the physical relation, further on 08.12.2022, Rakesh took her to his home assuring that he will marry but his parents abused and ousted her and Rakesh also refused to marry, as his parents were not ready.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.33001 of 2023(2) dt.01-08-2023 2/2 petitioners have been falsely implicated in the present case, it is next submitted that from perusal of the allegations as alleged in the FIR it would manifest that the informant has alleged that Rakesh on pretext of marriage established physical relation and when he brought the informant to his house, his parents ousted her and refused from marrying Rakesh with her, it is further submitted that the petitioners being mother and father of Rakesh have been falsely implicated in the present case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Forbesganj P.S. Case No. 1344 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
