1. Heard the parties.

2. The petitioner has filed the present writ application assailing the advertisement no. 210 of 2010 issued for the post of appointment of Assistant Teacher in Government Primary Middle School on the ground that the petitioner, being disable person of general category has not been selected in the said process.

3. Learned counsel for the Bihar Staff Selection Commission submits that the petitioner was considered under disable quota (Ortho) for the post of Assistant Teacher, notified under advertisement no. 210 of 2010.

Patna High Court CWJC No.880 of 2017(10) dt.01-07-2024 2/2 The petitioner participated as a disabled candidate DQ (Ortho) under general category and his training session was 1987-89. He obtained 64.40 marks in his training. The details of the petitioner were verified from the original records of the Commission and it has surfaced that the cut off session under marks of the general category DQ (Ortho) for the Session 1987-89 is 75.53. The petitioner, though had completed his training in the cut off session 1987-89, had secured lesser marks i.e., 64.40 which is below the cut off marks of DQ (ortho) i.e., 75.53.

4. In view of the specific stand of the Bihar Staff Selection Commission and the fact that the petitioner has obtained lesser marks than the cut off marks fixed for DQ (Ortho), I do not find any merit in this writ application.

5. Accordingly, the present writ application is dismissed with the aforesaid submission and observation. (Anil Kumar Sinha, J) HarshPandey/- U
