JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 10.07.2020 in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.

According to the prosecution case itself, petitioner was driver cum owner of the pick up van and petitioner was caught on the spot.

Submission on behalf of the petitioner is that petitioner does not have any concerned with the seized liquor

Patna High Court CR. MISC. No.32037 of 2020(2) dt.09-12-2020 2/2 and moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since long. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 2nd, cum Special Judge, Excise, Samastipur in connection with Hasanpur P.S.Case No. 133 of 2020.

It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioners shall be deemed to be confirmed.
