Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Birpur (Balua Bazar O.P.) P.S. Case No. 33 of 2021, registered for the offence punishable under Section 379 of the Indian Penal Code.
The First Information Report was registered against unknown on the allegation of theft of a motorcycle. In course of investigation, the petitioners' name surfaced as the perpetrators of the crime.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.42310 of 2021(2) dt.06-01-2022 2/2 petitioners has submitted that the petitioners are in custody since 28.01.2021 and since the charge-sheet has been submitted, no tangible purpose is going to be served if the petitioners are compelled to remain in custody any more.
Considering the fact that the petitioners have remained in custody since 28.01.2021, this application is allowed.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, Supaul, in Birpur (Baluabazar O.P.)
