Although petitioner is not named in the first information report but in course of investigation when further statement of the informant was recorded at para 15 of the case diary, informant stated that this petitioner opened fire causing fire arm injury to the deceased as well as injured.

Therefore, taking note of the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail. Accordingly, his prayer for bail in connection with Sessions trial no. 58/2014 arising out of Chausa P.S. Case no. 138/2013 pending in the court of Addl. Sessions Judge I, Madhepura stands rejected.

However, the learned trial court is directed to expedite the
