JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30, 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.

According to prosecution case itself, the alleged recovery was made from the house of co-accused Uday Kumar and so far as petitioner is concerned, it is alleged that he was caught while he was fleeing from the place of occurrence. Petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court CR. MISC. No.32009 of 2020(3) dt.19-01-2021 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge (Excise), Sitamarhi in connection with Nanpur P.S. Case No. 219 of 2020.
